ASHLAND — Cody Dye, the Ashland man who charged with felonious assault for allegedly attacking his mother prior to being shot by an Ashland police officer, had his first court appearance Monday. 

Dye has been charged with felonious assault and domestic violence by Ashland Police. 

Ashland County Common Pleas Magistrate Paul Lange set bond at $10,000 during a bond setting hearing via Skype. If Dye posts bond, he will be under house arrest with GPS monitoring until his next court appearance at 9 a.m. Wednesday. 

Dye was also ordered to comply with all prescribed medical and mental health treatment. 

Ashland County Prosecutor Christopher Tunnell told Lange he spoke with Dye’s mother, Angela Mackey, earlier Monday.

Mackey told Tunnell the alleged assault and the shooting took place after her son was release from a mental health treatment facility. Dye had run out of his prescribed medication and attempted to self-medicate with alcohol March 16, the day of the incident, according to Tunnell. 

Dye returned home intoxicated and began to threaten his family members. He also attempted to swallow a handful of sleeping pills while Mackey was on the phone with a 911 dispatcher. 

After that, Tunnell said, Dye attacked Mackey with a straight-edge razor. 

At some point during the incident, Dye was shot by police officer Lee Eggeman. The shooting is under investigation by The Ohio Bureau of Criminal Identification and Investigation and is not part of the case against Dye. 

Dye was released from the hospital Saturday and is staying with family outside Ashland County, Tunnell said. 

Mackey has asked the court forgo issuing a no-contact order between herself and her son. Lange did not make an order of no contact. 

Dye told the magistrate he believed his family was hiring an attorney to represent him. Dye did not know the name of the attorney. Tunnell said he had been contacted by attorney Joseph Kearns regarding the case.
