MANSFIELD — A Shelby man faces a possible life sentence related to alleged sexual crimes committed during a four-year period.

David Irwin, 44, of Shelby, was indicted on 20 charges by a Richland County grand jury, including rape and sexual battery, among others.

Teri Burnside, Richland County First Assistant Prosecutor, said Irwin allegedly committed sex crimes against two juveniles from July 2019 to December 2023.

“We have multiple counts of rape for different acts,” Burnside said, adding both victims were younger than 13 years old.

One of the two juvenile victims became older than 13 during the alleged period when sex crimes were committed against them.

However, if convicted, Burnside said a life prison sentence remains a possibility for Irwin due to the victims’ ages during the time alleged crimes were committed.

“He’s looking at life (in prison),” she said, adding Irwin previously spent time behind bars for a gross sexual imposition conviction in 1998.

Butler man indicted on attempted murder charge

Nicholas Tess, 35, of Butler, has been indicted on multiple charges, including attempted murder, four counts of felonious assault and misdemeanor resisting arrest.

Tess was involved in an April 12 alleged attack on two males at Rainbow Gardens, a Lucas bar, Burnside said, adding he’d allegedly become “obnoxious” with bar staff and patrons.

“They (bar staff) just wanted him (Tess) to pay and leave,” she said. “He pulled out a knife and stabbed two men, both (suffering) serious physical harm.”

Tess’ attempted murder charge, a first degree (F-1) felony, carries a maximum sentence of 11 years behind bars. Each felonious assault charge (F-2) results in up to eight years in prison.

If convicted, Burnside said Tess could face a maximum sentence of between 19 to 27 years, depending on any charges merging.
