MANSFIELD — A Mansfield jewelry store is celebrating its upcoming anniversary with a localized version of the famous Forrest Fenn treasure hunt.

Miller’s Diamond Jewelry announced its city-wide treasure hunt Tuesday, July 2 on Facebook by releasing a poem with clues to a deed, which can be redeemed at the 1442 Lexington Ave. store for a minimum of $680 worth of in-store purchases or in-house repairs.

“We at Miller’s thought it would pose an exciting challenge for the Mansfield community to recreate this treasure hunt, in a much more safe and contained environment, as a way of celebrating Miller’s 68th anniversary, Mansfield’s history, and the exciting regrowth of our downtown life,” the Facebook post said. 

Kyle Miller, who’s the third generation of his family to work at Miller’s and the son of the current owners, came up with the concept after learning about the Forrest Fenn treasure hunt last year.

Supposedly, a wealthy art dealer, Fenn, hid a collection of valuables somewhere in the Rocky Mountains and published directions to the elusive loot in a poem within his memoir, The Thrill of the Chase. He’s said only a map, geographical knowledge and the poem are needed to find the treasure.

Still, no one has found it. Four people have died in that search, allegedly for a treasure worth $2 million.

Miller obviously has no interest in anyone getting hurt, but immediately realized an opportunity for a unique store giveaway on a much smaller scale. 

He wrote an eight-stanza poem similar to the one written by Fenn and hid a deed in a waterproof bag somewhere on public property in Mansfield. The person who finds the deed is instructed to bring it to the store to win the jewelry store’s prize.

Knowledge of Mansfield, Miller said, is all it takes to find the deed. 

“I think it’s pretty challenging. I’ve had people here (at Miller’s) try to work through it, and nobody’s been able to figure it out,” he said. “Someone could right away know where it is, but I hope it lasts throughout the summer and people get to have some family fun looking for it.”

He’s hopeful the hunt will last at least a month, which would line up ideally with the store’s August anniversary celebration.  He reminded people to be safe while searching and noted that no digging is needed to find the deed.

To redeem the prize, the winner must be 18 or older. Only one prize is offered. 

And though recognizing the jewelry store’s dollar prize is pale in comparison to the up to the seven-figure prize hidden somewhere north of Santa Fe, he’s optimistic the Mansfield-hunt will spark at least local interest.

These are the Official Rules for the Miller’s Jewelry, Inc. dba Miller’s Diamond Jewelry (“Miller’s Jewelry”) “Miller’s and the Mystery of Mansfield’s Mystic Mine” Scavenger Hunt (the “Scavenger Hunt”).  

 

  1. Eligibility:  The Scavenger Hunt is open only to legal residents of the fifty United States and the District of Columbia, and is void where prohibited by law. You must be 18 years or older on the day you enter the Scavenger Hunt to win the prize. Employees, contractors, agents, directors, and officers of Miller’s Jewelry, their respective parents, affiliates, subsidiaries, advertising and promotion agencies, suppliers, retailers, sales representatives, dealers, distributors, licensees, and their immediate family members (regardless of where they reside) and/or those    living in the same household (whether or not related) of each are not eligible to participate in the Scavenger Hunt. The Scavenger Hunt is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law, rule, or regulation or anywhere not listed above. The Scavenger Hunt is in no way sponsored, endorsed or administered by, or associated with Facebook. By entering this Scavenger Hunt, each participant warrants that he or she has read and agrees to abide by all Scavenger Hunt Official Rules and that he or she is not prohibited from participating in the Scavenger Hunt.

  2. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Miller’s Jewelry as final and binding as it relates to the Scavenger Hunt, the content, and the winner.  Miller’s Jewelry’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  3. Scavenger Hunt Period: The Scavenger Hunt will run from July 2, 2019 at __11 AM_____ ET until the Prize (as defined below) is awarded (the “Scavenger Hunt Period”).  The Prize for the Scavenger Hunt will be awarded upon presentation of the Special Coupon (defined below) to Miller’s Jewelry at its retail store located at 1442 Lexington Avenue, Mansfield, Ohio, 44907 (the “Retail Location”).  The Special Coupon must be remitted to Miller’s Jewelry at the Retail Location by close of business on ___August 31, 2019 at 4:00 PM__________ to be eligible to collect the Prize.

  4. How to Enter:  You may enter the Scavenger Hunt by using the clues available on-line in the Scavenger Hunt promotions located on the Miller’s Diamond Jewelry Facebook page (www.facebook.com/millersdiamondjewelry/), including, but not limited to, live streams, poems, background story information, and other clues posted by Miller’s Jewelry (the “Clues”) during the Scavenger Hunt Period.  The Clues are designed to lead participants on a series of quests in and around Mansfield, Ohio, all on easily accessible public property, ultimately ending with the discovery of a bag containing a special coupon (the “Special Coupon”), which will be located in an undisclosed public area in or around the City of Mansfield, Ohio.  The Scavenger Hunt Clues provide clues and instructions on how to locate the Special Coupon. The winning participant will be the first person to locate the bag containing the Special Coupon and present it to Miller’s Jewelry at the Retail Location.  

No formal entry form must be completed to enter the Scavenger Hunt.  However, the winning participant who locates the Special Coupon and submits the Special Coupon to Miller’s Jewelry to collect the Prize agrees that he/she consents to participate in the Scavenger Hunt and for Miller’s Jewelry to obtain and use the participant’s legal name, address, biographical information, and likeness for public promotion of the Scavenger Hunt.  Participants must fulfill all Scavenger Hunt requirements, as specified, to be eligible to win the Prize. Participants that do not adhere to the Rules or specifications may be disqualified at the sole discretion of Miller’s Jewelry. If you use fraudulent methods, commit any crime (including, but not limited to, trespass), violate any law, commit bodily injury or property damage, attempt to tamper with or impair Scavenger Hunt administration, security, fairness, or proper play, or otherwise attempt to circumvent the Rules, you may be removed from eligibility at the sole discretion of Miller’s Jewelry.  Miller’s Jewelry will not be responsible if there is theft, tampering, destruction, or unauthorized access to, or alternation of the Special Coupon or it becomes lost, late, misdirected, stolen, or mutilated, nor will Miller’s Jewelry be responsible for any technical or mechanical malfunctions; printing or other errors; errors in the Official Rules, in any related ads or materials; or processing error. Should the Scavenger Hunt be terminated prior to the stated expiration date, notice may be posted at www.millersjewelry.com website and on Miller’s Jewelry’s Facebook page.  

Participants agree to drive safely while participating in the Scavenger Hunt and to not use their cell phones while driving.  

  1. Prize:  The winner of the Scavenger Hunt will receive his or her choice of an assortment of jewelry chosen by Miller’s Jewelry with a retail value of $680.00 US (the “Prize”).  The winning participant can only redeem his/her prize by presenting the Special Coupon to personnel at Miller’s Jewelry’s Retail Location. The Special Coupon must be presented at the Retail Store by close of business on __August 31, 2019 at 4:00 PM____________ to be eligible to collect the Prize.  No cash or other prize substitutions or transfer/assignment of the Prize to others are permitted except at Miller’s Jewelry’s sole discretion; provided, however, that the winning participant may apply the retail value of the Prize to another piece or pieces of jewelry in stock at Miller’s Jewelry or to an in-house jewelry repair order at Miller’s Jewelry. The Prize may not be used as a credit to the winner’s account or applied to any existing orders. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Prize winner may receive an IRS 1099 form for the value of the Prize and agrees to provide all information necessary for Miller’s Jewelry to remit such IRS 1099 form, including filling out an IRS W-9 form.  Acceptance of Prize constitutes permission for Miller’s Jewelryto use winner’s name, likeness, biographical data, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.  Prize details not set forth herein are at the sole discretion of Miller’s Jewelry.  

  2. Odds: The odds of winning depend on the number of eligible participants who participate in the Scavenger Hunt.

  3. Winner selection and notification: The receipt by winner of the Prize offered in this Scavenger Hunt is conditioned upon compliance with these Rules and any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT MILLER JEWELRY’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SCAVENGER HUNT AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

  4. Rights Granted by you: By entering this Scavenger Hunt, you understand that Miller’s Jewelry and anyone acting on behalf of Miller’s Jewelry, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review, or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, should you win the Scavenger Hunt, including, without limitation, your name, portrait, picture, voice, likeness, image, or statements about the Scavenger Hunt, and biographical information as news, publicity, or information and for trade, advertising, public relations, and promotional purposes without any further compensation.  Any other use of the winning participant’s personal information by Miller’s Jewelry shall only be as set forth in the in-store general privacy policy, available upon request at the Retail Location.  

  5. Terms:  Miller’s Jewelry reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Scavenger Hunt should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud, Act of God, or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Scavenger Hunt.  In such case, Miller’s Jewelrymay select the Prize recipient from all eligible participants participating prior to and/or after (if appropriate) the action taken by Miller’s Jewelry.  Miller’s Jewelry reserves the right at its sole discretion to disqualify any individual who behaves in an unsportsmanlike manner, tampers or attempts to tamper with the entry process or the operation of the Scavenger Hunt, Miller’s Jewelry Facebook page, or website, or violates these Rules.  Miller’s Jewelry has the right, in its sole discretion, to maintain the integrity of the Scavenger Hunt, to void entries for any reason. Any attempt by an entrant to deliberately damage any web site or Facebook page or undermine the legitimate operation of the Scavenger Hunt may be a violation of criminal and civil laws and should such an attempt be made, Miller’s Jewelryreserves the right to seek damages from any such person to the fullest extent permitted by law.  

  6. Limitation of Liability: By entering the Scavenger Hunt and/or accepting receipt of the Prize, you agree to release, discharge, and hold harmless Miller’s Jewelry and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, managers, members, shareholders, and directors from and against any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Scavenger Hunt and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical or electronic failures or errors of any kind, including but not limited to the malfunctioning of any computer, server, provider, social media platform, cable, network, telecommunications, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Scavenger Hunt; (v) claims based on publicity rights, defamation, or invasion of privacy; and (vi) electronic or human error which may occur in the administration of the Scavenger Hunt or the processing of entries.  

PARTICIPANTS UNDERSTAND AND AGREE THAT THEIR PARTICIPATION IN THE SCAVENGER HUNT IS ENTIRELY AT THEIR OWN RISK, AND THAT THEY ARE AWARE OF THE RISKS ASSOCIATED WITH THEIR PARTICIPATION, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. PARTICIPANTS UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM THEIR OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL AROUND THE SCAVENGER HUNT OR ITS LOCATIONS. PARTICIPANTS AGREE TO INDEMNIFY AND HOLD HARMLESS, MILLER’S JEWELRY, AS WELL AS THEIR SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS, MANAGERS, MEMBERS, SHAREHOLDERS, AND DIRECTORS AGAINST ANY AND ALL CLAIMS, SUITS OR ACTIONS OF ANY KIND WHATSOEVER FOR LIABILITY, DAMAGES, COMPENSATION OR OTHERWISE BROUGHT BY PARTICIPANT OR ON PARTICIPANT’S BEHALF.

  1. Disputes: THIS SCAVENGER HUNT IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF OHIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Scavenger Hunt, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Scavenger Hunt, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Richland County, Ohio having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, exemplary, indirect, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Scavenger Hunt), and participant further waives all rights to have damages multiplied or increased.
